End-User License Agreement (EULA) & Secure Enrollment Policy
Welcome to the KBS Driving School website and portal dashboard. By accessing our platform, enrolling in courses, or completing payment transactions, you agree to be bound by this End-User License Agreement (EULA) and Terms & Conditions. Please read these terms carefully.
Secure Payment & Payment Vendor Liability Decoupling
All digital financial transactions on our platform are processed securely via Paystack (licensed under PCI-DSS compliance). We do not directly store or possess your credit/debit card credentials, bank accounts, or CVV digits on our systems.
Decoupling of Financial Liability: Because all transactions are executed within Paystack's external secure environment, KBS Driving School holds absolutely zero responsibility or legal liability for transaction failures, bank declines, unauthorized card charges, double billing, or network drops occurring inside the Paystack gateway. Any financial processing claims, disputes, or chargebacks must be addressed directly to Paystack's support networks.
Localized Physical Service Nexus & International Payments
No Cross-Border Digital Product: We do not offer online digital products, downloadable software, or remote SaaS subscriptions. We provide a strictly localized physical service (practical driving instructions, classroom physical sessions, and local NTSA test bookings) that requires being physically present inside the Republic of Kenya.
Any international payment processed on this platform is executed under the strict mutual legal assumption that:
- The student is physically in Kenya, or will be physically present in Kenya, to complete the training course.
- The student holds a valid visa, study permit, or residency status that allows them to enroll in and complete driving curriculums under Kenyan law.
- Tax Responsibility: Since our services are physically rendered in Kenya, we do not collect or remit foreign digital services taxes (DST), regional VAT, or sales taxes of other countries. International students are solely responsible for declaring and handling any taxes or compliance duties required by their home jurisdiction.
No-Show & 5-Week Attendance Grace Period
Upon clearing payment, a booking is confirmed. We enforce a strict scheduling and refund limit on customer no-shows:
- The 5-Week Attendance Grace Period: You are granted a grace period of **5 weeks** from the date of payment clearance to physically present yourself at our training center and begin your sessions.
- Strict Refund Denial: If you do not show up to attend classes within this 5-week grace period, **you are absolutely barred from requesting any refund**. Refunds will not be processed under any circumstances.
- Course Retention: Although you are barred from receiving a refund, you are still fully allowed to attend the physical classes at a later date. Your paid curriculum credentials remain valid on our database, but the payment itself becomes non-refundable.
- 24-Hour Self-Service Window: Standard digital self-service refunds can only be triggered via the student dashboard within **24 hours** of transaction clearance, prior to physical class activation.
GDPR & Data Protection Compliance
In compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and regional data privacy laws, KBS Driving School respects your digital rights.
What We Process
Full name, active email address, contact phone number, enrollment state, course booking schedules, payment references, and digital course certificates.
Your Legal Rights
- Right of access & data portability
- Right to prompt rectification of records
- Right to be forgotten (permanent erasure)
- Right to restrict or object to processing
Student Code of Conduct
Users are granted a limited, non-exclusive, non-transferable license to access the KBS online learning materials and practice exams. You agree not to reverse engineer the portal, share tokens, or engage in malicious actions that disrupt server operations.
Legal Disclaimer & Liability Limits
KBS Driving School shall not be held liable for delayed digital training modules due to third-party telecommunications failure or force majeure. We reserve the right to suspend any student portal dashboard account found violating these conditions.
